Any person accused of a crime (an accused) has the right to make a “full answer and defence”. This means that the Crown lawyers (those that are arguing that the accused is guilty) must give the defence a list of all evidence and witnesses that they will be calling in court. Because of this principle, there is no such thing as a “surprise” witness in Canadian courts. Also, in Canadian courts, journalists and members of the public are not allowed to take pictures or film anything that happens in the courtroom.
